Durable Power of Attorney

Generally speaking, a power of attorney is a writing that gives legal authority to a third party (agent) to act on the behalf of someone else (principal).

In estate planning, these tools are used to insure someone you trust manages your financial and health care decisions when you no longer can.

For estate planning purposes, it is imperative that the power used can be classified as a “durable” power. In short, this classification allows your agent to act even if you become incapacitated.

If you currently have a power of attorney and are unsure if your document can be classified as durable, Patrick will review your document during your consultation initial consultation.

While we all hope we don’t need to use the insurance we pay for, we are glad it’s there when we need it. There are no good excuses for an adult to be without financial and health care power. Meet with Attorney Patrick and get your protection in place.

Choosing an Agent / Advocate

An individual or individuals nominated to handle your financial and health care decisions have a real responsibility. You need someone in place that can handle this responsibility.

Some important attributes of a good agent/advocate candidate include:

  • Trustworthiness.
  • Previous experience making decisions they will be faced with.
  • Easy to communicate with as necessary.

What is most important is that your agent/advocate be the best choice for your circumstances. This process is not about making people feel equal. It is about assuring your wishes are followed when you no longer have a say in the matter.
